It has been reported by jailbreak users that AT&T is now forcing them to 2 GB tiered data plans for 45$ a month removing them from their existing unlimited data plans. This is happening in the case of MyWi users who tether their iPhone’s as a modem . It is not known yet if PDANet users are being detected and removed too .
After AT&T removed their unlimited plan , old customers kept enjoying unlimited data and used jailbreak apps like MyWi to tether their phone to be used as a WiFi Hotspot and access internet on other WiFi enabled devices like laptops, iPod Touch , iPad and personal computers etc .

Earlier this year, we began sending letters, emails, and text messages to a small number of smart phone customers who use their devices for tethering but aren’t on our required tethering plan. Our goal here is fairness for all of our customers. (This impacts an only small percentage of our smart phone customer base.)
The letters outline three choices :
1) Stop tethering and keep their current plan (including grandfathered unlimited plan).
2) Proactively call AT&T or visit our stores and move to the required tethering plan.
3) Do nothing and we’ll go ahead and add the tethering plan on their behalf — after the dated noted in their customer notification.
Earlier this week AT&T announced that they will be throttling the data speeds for users who reach a certain download-upload limit. The affected user will then get internet access at reduced speeds . You can read the complete story here .

I discontinued use of tethering and I still got my plan changed, my guess is that they are basing this on data consumption because I consumed a lot of data on the phone rather than tethering. They still say im tethering and that changes are due for next billing cycle. I’m also thinking that since I didn’t upgrade to 4.3.3 on the iphone that’s how they assume im jailbroken and tethering.
